Conditions of Use

Welcome on SierraFoxHobbies.
At SierraFoxHobbies our first rule is to have happy and satisfied customers. We answer your questions quickly (and, yes, we reply to your e-mails), we are ready to help you as much as we can to give you the best from what you purchased, and we give you suggestions based on our personal experience or witness. What you see on this website is actually available. If a product is not listed it means it is momentarily out of stock.
Sometimes a product goes out-of-stock outside working hours so we cannot put it off-line in time before you order it. If this happens to you, we will contact you for a replacement or to arrange any other solution you prefer.
Products subjected to special regulations (i.e. HPR motors) are not visible on the website although available, and cannot be purchased unless you provided us your HPR certification. See below.

Application of the General Terms and Conditions of Sale
The General Terms and Conditions of Sale outlined below (hereafter known as "General Conditions"), govern the contractual relationship between any user of the SierraFoxHobbies.com website and the company Volo Milano snc, whose head office is situated at Via Anguissola 54 – 20146 Milano (Italy) registered on the Chamber of Commerce of Milan under the number 1479751 and on the Law Court of Milan under the number 356757/8712/7 (hereafter known as "SierraFoxHobbies"). These general terms and conditions shall be the only ones applicable and replace all other conditions, except in the case of express written consent. SierraFoxHobbies may be occasionally obliged to modify certain provisions of its general conditions. It is therefore necessary to re-read the said conditions before each purchase on the SierraFoxHobbies.com site. We consider that in submitting your order, you have read and accepted our general conditions of sale without reserve.
Any order by the Client implies a tacit acceptance of the present General Conditions of Sale and without reserve. Any clause accompanying a Client’s order or any other document (such as the General Conditions of Purchase by the Client), that is in opposition to, or which adds a new element to the present General Conditions, will not be accepted by SierraFoxHobbies.

Prices
The products sold by SierraFoxHobbies are billed in Euros and VAT included at the price quoted on the day of the registration of the order by SierraFoxHobbies. It does not include delivery charges. SierraFoxHobbies reserves the right to modify its price at any time and in compliance with current laws.

Forwarding – Delivery
SierraFoxHobbies decides on the mode of delivery. The risks associated with delivery are the responsibility of the client. The Client must, as of reception, inspect the parcels within the legal timeframe. Please note, conditions such as "acceptance conditional upon verification" or "acceptance conditional upon opening of wrapping” have no legal value with insurers or with transporters.
It is the Client’s responsibility to provide proof of missing or broken articles.
SierraFoxHobbies will strive to respect the stated delivery times, but cannot be held liable for interest and damages because of late delivery and cannot accept the cancellation of an order on that basis. An order made for articles not in stock may be the object of a longer period of delay or a cancellation.

Returns
The products can only be returned after written authorisation from SierraFoxHobbies. Returned products must be addressed to SierraFoxHobbies with delivery paid for. The returned products must be in perfect conditions, carefully packaged and without any sort of modification with respect to reference and series numbers. They must have their labels intact, along with their stamps or marks permitting their resale. In the event of non-authorised or non-conforming return of goods, the merchandise will systematically be returned to the Client at his expense.

SPECIAL POLICY FOR DOWNLOADABLE PRODUCTS
A downloadable product can be downloaded the number of times indicated on the download page. The download link expires after the number of days indicated. The customer is responsible for storing and keeping the software downloaded. SierraFoxHobbies shall not be made liable or held responsible for loss of the product on customers side.

SPECIAL POLICY FOR RESTRICTED PRODUCTS
- HPR motors are sold only to people who are holding the corresponding TRA certification level or a corresponding certification of an organization whose certification program is directly recognized by TRA.
- We currently cannot accept European NAR certifications due to problems with the enforcement of NAR's own system.
- The buyer must not sell to people who are not holding the required certification. The dealer reserves the right to take legal action if this is not complied.
If you are purchasing these products please fax us a copy of your certification (+39-024041116) or send it by registred mail. You will be enabled to the purchase after we checked your certification. SierraFoxHobbies has the right to refuse to sell any restricted product to anyone anytime (even if a valid certification is submitted) if safety concerns should arise.

Guarantees
Products sold by SierraFoxHobbies benefit from a guarantee of conformity for one year as of the date of delivery for the goods sold. (Community directive n°99/44/EC dated May 25, 1999, relative to certain aspects of sales and guarantees for consumed goods). Return costs incurred during transit are to be covered by the customer.
The product should be returned by the national postal service. Any returned product must be accompanied by a copy of your invoice. The guarantee does not apply when malfunctioning results from damage caused by exterior elements, accidents (notably electrical, physical damage, misuse etc.) any actions that are against the advice and instructions given in the product manual. The guarantee conditions also exclude all products that have been modified or repaired by the customer or a non-authorised repair centre.
The guarantee for products sold by SierraFoxHobbies does not cover:

- the replacement of consumables (motor reloads, ignitors, wadding, etc.)
- the irregular usage or non-conforming usage of products. Please consult the instruction manual delivered with your product.
- malfunctioning due to usage with accessories (power cables, batteries, etc)
- malfunctioning due to repairs effected by non-authorized personnel
- malfunctioning due to external causes
- malfunctioning due to non-conforming usage of the product (professional usage, collective usage etc)

SierraFoxHobbies cannot be held responsible for the warranty should the manufacturer not honour the guarantee.

Trademarks
Trademarks distributed by SierraFoxHobbies are protected by current laws and international conventions.
As a consequence, neither Clients nor third parties can use trademarks without the express written consent of the trademark holder. It is understood and agreed that the acceptance of the present General Conditions is not in any way such an authorisation.

Liability limits
No liability will be accepted for loss or damages, direct or indirect, whatever the cause. In no case will the Client, for any reason, withhold funds from an invoice for an incomplete delivery or for defective goods.

Ownership of Property
SierraFoxHobbies remains the owner of the merchandise delivered until the payment is made in full. A promise of payment is not considered full payment until said payment has actually been processed.
Any damage caused while in the possession of the client, should said client not have paid in full, is his responsibility.

Applicable law – Attribution of jurisdiction
In the event of a failure to amicably resolve payment, all litigation involving SierraFoxHobbies and its Clients will be settled exclusively in the Courts of Milan with the applicable law being Italian law.
